Trademark Class list

New Trademark Class list in India

You must know how important a trademark has become for any business nowadays. Be it any kind of business, small or big, a small brand or a famous big brand, even if it is a small startup, it is necessary for all of them to register their trademark for their protection and to increase their value in the market. The most important thing in the entire trademark Registration process is to select the appropriate category for your brand or your trademark based on the products and services of the brand or business. You can also choose multiple classes  for your business. Trademark Class list and their selection play a significant role in the process of trademark registration. And it is very important to choose the correct class for your trademark.

What is a Trademark?

A trademark is a word, colour, shape, pattern, image, text, slogan, or phrase that helps to distinguish the products and services of a brand in the market. It gives a unique identity and recognition to any brand in the market. It also provides exclusive legal rights to protect the brand from infringement, counterfeiters, and unauthorized use. It also helps build consumer trust. Registering a trademark provides legal protection so that others cannot use the trademark or brand without the permission of the trademark owner.

Trademark Classes

Trademarks are divided into several classes based on different products and services. This classification is done under the Nice Classification, which is instituted by the World Intellectual Property Organization (WIPO). In which there are a total of 45 trademark classes. Each class includes goods and services of a particular nature. While applying, the applicant is required to identify the appropriate trademark class for their trademark based on the product and service of their brand. This classification system is important for conducting a thorough trademark search and taking legal protection measures against trademark infringement.

NICE Classification of Trademark Classes

The Nice Classification is an international system established by WIPO in 1957 and later revised. It is used to classify goods and services in trademark registrations worldwide. The Nice Classification was adopted by India in 2019.

The Nice Classification has a total of 45 classes, wherein:
Classes 1-34 classify products.
Classes 35-45 classify services.

Importance of Trademark Classes

Selecting the appropriate trademark class is a very essential step in the process of trademark registration. This selection is done before applying for registration of the trademark. The trademark class helps to confirm that the chosen trademark is not similar to any other existing trademark of the same class. This classification of trademark classes indicates that every product and service associated with the trademark is classified differently according to their nature so that every product and service can be identified based on an accurate description.

This helps prevent others from registering similar trademarks in the same class.
It also reduces the hazard of legal disputes by avoiding conflicts with other existing trademarks.
The trademark classification complies with international trade policies and quality standards.
